Translation note and governing version. This English text is a courtesy adaptation prepared for readers outside Mexico. Atum Innovations is a Mexican company and the Spanish version of these Terms is the binding one. You can reach it from the language switcher at the top of this page. If the two versions differ in meaning, the Spanish version prevails.

The short version. This site is informational. Nothing published here is a binding offer, and none of it replaces the contract we would sign if we work together.

1. Who we are

This website and its subdomains (the “Site”) are operated by Atum Innovations, S.A.S. de C.V. (“Atum”, “we”), a company incorporated in 2026 under the laws of the United Mexican States, with registered address at Valle del Amazonas 251, Valle de Aragón, Nezahualcóyotl, Estado de México, C.P. 57100, Mexico.

2. Scope

These Terms govern access to and use of the Site. Nothing more.

They do not govern the delivery of software development services, systems implementation, or use of the Punto de Encuentro platform. Those relationships are governed by the specific agreements executed between the parties, which prevail over this document in everything concerning them.

If a signed agreement between you, or your organization, and Atum contradicts anything written here in respect of contracted services, the agreement wins.

3. Acceptance

By accessing or using the Site you accept these Terms. If you do not agree, do not use it.

If you access the Site on behalf of an organization, you represent that you have authority to bind it, and “you” means that organization too.

Using the Site and submitting the contact form constitute an expression of intent by electronic means, under the data message provisions of Mexico’s Commercial Code.

4. The Site is informational — not an offer

Content on the Site is provided for information and commercial presentation.

It is not: a binding offer, an irrevocable proposal, professional, technical, legal, tax or financial advice, or any commitment as to availability, functionality, timeline or outcome.

The Site does not publish pricing. Any quote is issued in writing, individually, with an express validity period, and binds Atum only on the terms stated in it.

Descriptions of Punto de Encuentro functionality and of our services describe general product and practice capabilities. What you actually receive depends on the configuration and the scope contracted.

5. Permitted use

You may:

a) access and browse the Site for informational, personal or professional purposes;

b) reproduce short extracts for internal or reference use, with attribution and a link to the source page;

c) link to the Site from elsewhere, provided the link does not suggest affiliation, sponsorship or endorsement that does not exist, and does not present our content inside someone else’s frame.

6. Prohibited uses

You may not:

a) copy, reproduce, distribute or create derivative works from the Site, in whole or in substantial part, for commercial purposes;

b) extract content by automated means — scraping, data mining or bulk indexing — beyond what our robots.txt permits;

c) attempt to access non-public areas, systems or data, or circumvent technical protection measures;

d) introduce malicious code, overload the infrastructure, or otherwise interfere with the Site’s availability;

e) use the forms or the published contact details for unsolicited bulk messaging, impersonation, or any unlawful purpose;

f) use our trademarks, trade names or logos in a way that suggests affiliation, sponsorship or endorsement that does not exist;

g) present Site content as your own or strip attribution notices.

7. Intellectual property in the Site and the brand

All Site content — text, source code, shaders, animations, design, structure, the selection and arrangement of content, trademarks, trade names, logos and graphic elements — is owned by Atum or used with the owner’s authorization, and is protected under Mexico’s Federal Law for the Protection of Industrial Property, the Federal Copyright Law, and applicable international treaties.

“Atum”, “Atum Innovations” and “Punto de Encuentro” are distinctive signs of Atum. Nothing on the Site is a license or authorization to use them.

Accessing the Site transfers no intellectual property rights to you. Rights not expressly granted in section 5 are reserved.

About work we contract with clients. It is Atum’s policy that intellectual property, source code and data for custom development are assigned to the client, as agreed and paid for under the applicable contract. That policy is documented and made enforceable in that contract; mentioning it here is informational and does not by itself create rights or obligations. Excluded are Atum’s pre-existing components, third-party libraries under their own licenses, and the Punto de Encuentro platform, which is licensed and not assigned.

8. What you send us

By sending us information through the contact form or any other channel, you represent that you are entitled to share it and that doing so infringes no third-party rights and no confidentiality obligations of your own.

Please do not send confidential information, trade secrets, third-party personal data or sensitive information through these channels. Information received without a signed confidentiality agreement is treated as non-confidential, with one exception: personal data, which is handled under the Privacy notice.

You keep ownership of what you send. You grant us only the permission needed to read, store and use it in order to answer your enquiry and, where relevant, prepare a proposal.

We may decline to answer, or delete, messages containing unlawful, offensive, unsolicited promotional or automated content.

If we work together, confidentiality is governed by the specific agreement we execute.

9. Availability

We aim to keep the Site available and current, but we do not guarantee uninterrupted or error-free availability.

We may modify, suspend or discontinue the Site, or any of its sections and features, at any time and without notice. The Site may be unavailable due to maintenance, third-party failures or force majeure.

Site availability is unrelated to any service levels agreed in a services contract. Nothing in this section applies to those contracts.

10. Disclaimer of warranties

The Site is provided “as is” and “as available”.

To the fullest extent permitted by applicable law, Atum disclaims all warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, currency or completeness of information, freedom from error, and non-infringement.

We make an honest effort to keep content correct and current. If you spot an error, write to contacto@atum.mx and we will fix it.

11. Limitation of liability

To the maximum extent permitted by law, Atum is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost data, lost opportunity or reputational harm, arising from access to or use of the Site, or from any inability to use it.

We are also not liable for decisions you take on the basis of Site content alone, without a proposal or a contract in place.

This limitation does not apply to liability that cannot be excluded or limited under Mexican law, including liability for willful misconduct, bad faith or gross negligence, nor to consumer rights that law reserves for consumers. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; where that is the case, these limits apply only to the extent permitted there.

12. Indemnity

You agree to hold Atum, its shareholders, officers and personnel harmless from third-party claims arising from your use of the Site in breach of these Terms or of applicable law, including reasonable defense costs and fees.

13. Third-party links and services

The Site may link to sites operated by third parties, including those of our partners Mediatech (mdtch.mx) and Registro Eventos (registro-eventos.mx).

Atum does not control those sites and is not responsible for their content, availability, privacy practices or terms. You access them at your own risk and under each site’s own terms.

A link implies no association, sponsorship or endorsement beyond what the Site expressly states.

The Site currently embeds no third-party tools and loads no external scripts. If that changes, it will be stated in the Privacy notice.

14. Personal data

Personal data is handled under our Privacy notice, which forms an integral part of these Terms.

It sets out what we collect, why, who it goes to, how to exercise your ARCO rights under Mexican law and the equivalent GDPR and CCPA/CPRA rights, and how to withdraw consent. For any data protection matter, write to the Personal Data Department: legales@atum.mx.

15. Changes to these Terms

We may amend these Terms at any time. The version in force is always the one published on this page, with its update date and version number visible.

Changes take effect on publication. Continued use of the Site after an amendment constitutes acceptance. If you do not agree with an amendment, stop using the Site.

16. Severability and waiver

If any provision is held invalid, void or unenforceable, the rest stays in full force. The affected provision will be construed, or replaced, as closely as possible to the parties’ original intent.

Our not enforcing a provision at a given moment is not a waiver of the right to enforce it later.

17. Language

These Terms are issued in Spanish, which is the binding version.

This English version is a courtesy translation, adapted for readers outside Mexico. In case of any discrepancy between the two, the Spanish version prevails.

18. Governing law and venue

These Terms are governed by the laws of the United Mexican States.

For any dispute over their interpretation or performance, the parties submit to the competent courts of the Estado de México, expressly waiving any other venue that might apply by reason of their present or future domiciles or for any other cause.

This is without prejudice to any rights that consumer protection law reserves for people with that status, and without prejudice to mandatory rights you may hold under the law of your own place of residence.
